Ski Santa Fe - New Mexico Skiing

Welcome to Ski Santa Fe. These Terms of Service govern your use of our website, mobile applications, and services. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By using Ski Santa Fe services, you confirm that you are at least 18 years old or have parental/guardian consent, and you have the legal capacity to enter into these terms. If you do not agree with any part of these terms, you must discontinue use of our services immediately.

2. Use of Services

Ski Santa Fe grants you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes. You agree to use our services in compliance with all applicable laws and regulations.

3. Prohibited Conduct

You agree NOT to use our services to:

• Violate any local, state, federal, or international law

• Infringe upon intellectual property rights of others

• Transmit viruses, malware, or other harmful code

• Harass, threaten, or harm other users

• Attempt to gain unauthorized access to our systems or networks

• Scrape, crawl, or copy content without permission

• Use automated systems or bots to access our services

4. Lift Tickets and Season Passes

All lift tickets and season passes are non-transferable and non-refundable unless otherwise specified. Prices are subject to change without notice. Lost or stolen tickets will not be replaced. You must comply with all posted mountain safety rules and staff instructions when using lifts and trails.

5. Assumption of Risk

Skiing and snowboarding are inherently dangerous activities. By using our mountain facilities, you acknowledge and accept all risks associated with winter sports, including but not limited to collisions, falls, changing weather conditions, and terrain hazards. You agree to ski or ride within your ability level and comply with the Skier Responsibility Code.

6. Intellectual Property Rights

All content on our website and applications, including text, graphics, logos, images, videos, and software, is the property of Ski Santa Fe or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

7. User Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

8. Email and SMS Communications

By providing your email address or phone number, you consent to receive communications from Ski Santa Fe, including promotional emails, mountain condition alerts, and service notifications. You may opt out of promotional communications at any time by following the unsubscribe instructions in our emails or replying STOP to SMS messages. Transactional messages (order confirmations, safety alerts) cannot be opted out of.

9. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee that our services will be uninterrupted, secure, or error-free. Weather conditions, lift operations, and trail availability are subject to change without notice. We are not responsible for third-party services or websites linked from our platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKI SANTA FE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ski Santa Fe, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising out of or related to your use of our services, your violation of these terms, or your violation of any rights of another party.

12. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be resolved exclusively in the state or federal courts located in Santa Fe County, New Mexico.

13. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on our website with a new effective date. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.

14. Severability
